Terms of Use

These Terms of Use (“Terms”) constitute a legally binding agreement between Akbilisim (“we,” “us,” or “our”) and you (“you” or “your”) governing your access to and use of Buzzy, our websites, customer accounts, subscription services, software downloads, license-management services, updates, support services, and related digital products and services (collectively, the “Services”).

Buzzy subscriptions and digital software purchases are sold and processed through Paddle, our Merchant of Record. Paddle handles payment processing, recurring billing, invoicing, applicable transaction taxes, and related payment matters under its applicable Buyer Terms and policies.

By accessing our websites, creating an account, purchasing or subscribing to Buzzy, downloading or installing our software, activating a license, or otherwise using our Services, you agree to these Terms. If you do not agree to these Terms, you must not access or use the Services.

1. Overview and Products

  1. Buzzy Platform: Akbilisim develops and distributes Buzzy, a self-hosted publishing, viral media, and community software platform, together with official themes, companion plugins, templates, and related digital services.
  2. Premium Plugin Ecosystem: Depending on your subscription plan or purchased entitlements, Buzzy may provide access to official premium companion plugins, including Buzzy Content Agent, Buzzy Subscriptions, Buzzy Quizzes, Buzzy SEO Pro, Buzzy Forum, Buzzy Contact, and other official extensions that may be introduced in the future.
  3. License-Based Distribution: Buzzy and its companion software are licensed, not sold. Your rights to install, activate, modify, and operate the software are governed by our License Agreement.
  4. Product Evolution: Buzzy is actively maintained and continuously developed. We reserve the right to improve, modify, enhance, or adjust features, themes, plugins, and integrations where necessary for security, compatibility with new technologies, performance, or changing third-party APIs.

2. Accounts, Eligibility, and Security

  1. Eligibility: You must have the full legal capacity to enter into a binding agreement in your jurisdiction.
  2. Account Information: You agree to provide accurate, current, and complete information when registering an account, purchasing a subscription, activating a license key, or submitting support requests.
  3. Account Confidentiality: You are responsible for maintaining the confidentiality of your customer account credentials, license keys, and API tokens, and for taking reasonable steps to protect your account against unauthorized access.
  4. Anti-Circumvention: You agree not to use falsified information, fraudulent payment instruments, proxies, or identity-masking techniques to bypass licensing controls, tax regulations, sanction laws, or geographic restrictions.
  5. Account Misuse: Sharing account credentials or license keys with unauthorized third parties to circumvent website activation limits, distributing unauthorized software packages, fraudulent transactions, attacks on our infrastructure, or other material violations may result in suspension or termination subject to applicable law and these Terms.

3. Subscription Plans and License Entitlements

Buzzy is offered through recurring subscription plans. Current pricing, plan tiers, included features, and website limits are displayed on our official Pricing Page.

Our subscription tiers include:

  • Buzzy Standard: License for one (1) production website for Buzzy Core, essential post formats, core themes, access to eligible software updates while the subscription remains active, and standard technical support.
  • Buzzy Pro: License for one (1) production website for Buzzy Core plus all official premium companion plugins (Buzzy Content Agent, Buzzy Subscriptions, Buzzy Quizzes, Buzzy SEO Pro, Buzzy Forum, Buzzy Contact), access to eligible software updates while the subscription remains active, and Priority Technical Support.
  • Buzzy Agency: License for up to ten (10) production websites for Buzzy Core plus all official premium companion plugins, access to eligible software updates while the subscription remains active, and VIP Developer Support.

Detailed software installation, staging allowances, and activation rights are set forth in our License Agreement.

4. Pricing, Payments, and Taxes

  1. Pricing: Subscription fees are displayed prior to checkout. We reserve the right to revise subscription prices for future billing periods upon reasonable advance notice.
  2. Currency: Prices are billed in US Dollars (USD) unless another local currency is presented during checkout.
  3. Merchant of Record (Paddle): Paddle acts as our authorized Merchant of Record. Paddle processes all payments, collects applicable taxes, manages recurring billing schedules, and issues official purchase invoices under its applicable Buyer Terms.
  4. Taxes: Applicable VAT, GST, sales tax, or consumption taxes are automatically calculated and collected by Paddle at checkout in compliance with local tax jurisdictions.
  5. Currency Conversion & Banking Fees: Your bank, card issuer, or payment provider may apply international transaction fees or currency-conversion charges for which Akbilisim and Paddle are not responsible.
  6. Pricing Errors: In the event of a manifest typographical or technical error in pricing, we reserve the right to cancel the affected order and issue a full refund in accordance with Paddle’s policies.

5. Subscription Billing, Renewal, and Cancellation

  1. Recurring Billing: Subscriptions automatically renew at the end of each billing period (e.g., annual) using the payment method on file with Paddle, unless cancelled prior to the renewal date.
  2. Cancellation: You may cancel your subscription renewal at any time through your Akbilisim account portal or Paddle subscription-management tools. Cancellation stops future automated renewals while preserving your active entitlements until the conclusion of the already-paid billing term.
  3. Failed Payments: If a recurring renewal payment fails, Paddle will retry the charge in accordance with its retry schedule. If payment cannot be completed, access to software updates, downloads, new activations, and support will be suspended upon expiration.
  4. Plan Upgrades and Downgrades: Upgrading or modifying your subscription plan may result in prorated billing adjustments as shown during the upgrade process.

6. Subscription Expiration and Continued Use

When a Buzzy subscription expires without renewal:

  • Previously installed and activated copies of Buzzy and companion plugins on licensed production websites will continue to operate. Existing website content is not remotely disabled.
  • Access to new software downloads and packages from your customer portal will stop.
  • Access to new software updates, security patches, and bug fixes will cease.
  • Automatic in-app update delivery will stop.
  • Technical support access will cease.
  • New production website activations will be disabled.
  • Any subscription-dependent cloud or online features will become limited or unavailable.

Renewing your subscription restores access to downloads, updates, support, and activation capabilities.

7. Software Updates and Technical Support

  1. Software Updates: Active subscribers receive access to official software updates, including security patches, performance improvements, compatibility updates, and new features.
  2. Support Levels:
    • Standard Plan: Standard technical support via our ticketing system.
    • Pro Plan: Priority Technical Support with expedited response queues.
    • Agency Plan: VIP Developer Support with highest-priority ticket handling.
  3. Scope of Support: Technical support is provided for official Buzzy software, standard setup, documented configuration, and confirmed product bugs.
  4. Excluded Support Services: Support does not cover custom feature development, bespoke programming, third-party server or hosting management, database optimization, or repairing issues caused by unauthorized third-party modifications.

8. Premium Plugins and Add-Ons

  1. Official premium companion plugins (such as Buzzy Content Agent, Buzzy Subscriptions, Buzzy Quizzes, Buzzy SEO Pro, Buzzy Forum, and Buzzy Contact) are designed as extensions to the Buzzy core platform.
  2. When accessed through a Pro or Agency subscription, the right to receive new plugin versions, updates, security fixes, and technical support requires an active subscription.
  3. Individual plugin add-ons or standalone licenses (where offered) are governed by the specific entitlement terms disclosed at the time of purchase.

9. Third-Party Services and Integrations

Buzzy includes integrations with third-party platforms, APIs, and services:

AI Integrations (Buzzy Content Agent)

  • Buzzy Content Agent allows publishers to connect external artificial intelligence APIs (e.g., OpenAI, Anthropic, Google Gemini) to automate content creation and workflow tasks.
  • Akbilisim does not provide bundled third-party AI credits or API tokens unless explicitly stated.
  • You are solely responsible for obtaining your own API keys, paying usage fees incurred with your chosen AI provider, and adhering to their respective terms of service and content policies.
  • You are responsible for reviewing and verifying AI-generated content before publishing it on your website.

Publisher Payment Integrations (Buzzy Subscriptions)

  • Buzzy Subscriptions allows website owners to create paid memberships, paywalls, and subscriber tiers for their own audiences.
  • All financial transactions between you and your website’s users are processed through the payment gateway accounts (e.g., Stripe, PayPal) that you configure.
  • Akbilisim is not the Merchant of Record for transactions between you and your website users and does not handle, collect, or store those payments.
  • You are solely responsible for payment processor compliance, tax reporting, invoicing, refunds, chargebacks, and end-user terms for your website visitors.

Other Third-Party Services

  • Integrations with social networks, analytics services, reCAPTCHA, and mail delivery services depend on external APIs that may be modified or discontinued by their respective third-party providers. Akbilisim is not liable for changes or outages in third-party services.

10. Digital Delivery and Account Access

  1. Buzzy is delivered entirely in digital format.
  2. Upon successful order verification and payment confirmation by Paddle, you will receive access to your customer account, software download packages, and license activation keys.
  3. If order fulfillment is delayed due to automated fraud review or payment verification, our support team is available to assist at [email protected].

11. Refunds, Chargebacks, and Payment Disputes

  1. Refund Policy: Refunds are administered in accordance with Paddle’s Buyer Terms and Refund Policy, as well as any mandatory consumer-protection laws applicable in your jurisdiction.
  2. Refund Requests: Eligible refund inquiries may be submitted via Paddle buyer support or by contacting Akbilisim at [email protected].
  3. Payment Disputes: If a chargeback, payment reversal, or payment dispute is initiated, access to affected subscription services, licenses, downloads, or updates may be temporarily suspended while the transaction is reviewed. Fraudulent or abusive payment disputes may result in suspension or termination of the affected account or licenses, subject to applicable law and Paddle’s policies.

12. License Verification and Service Data

  1. Buzzy software communicates securely with Akbilisim licensing servers to verify subscription status, authorize updates, validate plugin entitlements, and prevent piracy.
  2. Transmitted data includes technical parameters such as license keys, installation URL, server IP, software version, PHP version, and request timestamps.
  3. Our licensing system does not read, inspect, or collect private editorial content, articles, comments, or member data stored on your self-hosted website.

13. Acceptable Use and Security

You agree not to use our websites, licensing servers, customer portal, or software to:

  • Engage in unlawful, fraudulent, defamatory, or malicious activities;
  • Distribute malware, viruses, trojans, or destructive code;
  • Upload, distribute, or publish “nulled”, cracked, or pirated copies of Buzzy or companion plugins;
  • Publish license keys, account credentials, or software packages in public repositories or warez forums;
  • Perform unauthorized security scanning, penetration testing, scraping, brute-force attacks, or denial-of-service attacks against our infrastructure;
  • Attempt to circumvent or reverse-engineer license activation or subscription enforcement mechanisms.

14. Intellectual Property

  1. Akbilisim retains all right, title, and interest in and to Buzzy, companion plugins, themes, official documentation, graphics, trademarks, and branding.
  2. Your rights to use the software are strictly defined by the License Agreement.
  3. The names “Buzzy,” “Akbilisim,” and associated logos are trademarks of Akbilisim and may not be used without prior written authorization.

15. Suspension and Termination

We may suspend or terminate access to accounts, subscriptions, licenses, downloads, or related Services where reasonably necessary because of:

  • fraud;
  • unauthorized redistribution or piracy;
  • serious security threats;
  • material license abuse;
  • malicious activity;
  • material violations of these Terms or our License Agreement.

Where reasonably possible, we may provide an opportunity to correct a violation before permanent termination.

Immediate action may be taken where necessary to protect users, payment systems, our infrastructure, or intellectual property.

Termination for breach does not create an additional right to a refund except where required by applicable law or Paddle’s applicable policies.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, BUZZY SOFTWARE, AND ALL ACCOMPANYING MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY.

AKBILISIM EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE OR SERVICES WILL BE UNINTERRUPTED, COMPLETELY SECURE, ERROR-FREE, OR COMPATIBLE WITH EVERY SERVER ENVIRONMENT, THIRD-PARTY PLUGIN, OR HOSTING CONFIGURATION.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AKBILISIM, ITS FOUNDERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR BUZZY SOFTWARE.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS, YOUR ACCOUNT, OR BUZZY SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU FOR THE APPLICABLE SUBSCRIPTION OR SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

18. Governing Law and Consumer Rights

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict-of-law principles.

Disputes shall be subject to the exclusive jurisdiction of the competent courts and enforcement offices of Istanbul, Turkey, subject to any mandatory statutory consumer-protection rights that cannot be waived under applicable local laws.

19. Changes to These Terms

We reserve the right to modify or update these Terms to reflect changes in Buzzy, subscription plans, payment arrangements, Services, legal requirements, or business operations.

The current version will be published on our website together with its “Last Updated” date.

Where required by applicable law, material changes will be subject to appropriate notice or consent requirements. Changes will not retroactively remove rights that cannot lawfully be modified.

20. Relationship to Other Terms

  • Software licensing and usage rights are governed by our License Agreement.
  • Data processing and privacy practices are governed by our Privacy Policy.
  • Purchase and billing transactions processed by Paddle are governed by Paddle’s applicable Buyer Terms and policies.
