License Agreement

This License Agreement (“Agreement”) is a legal agreement between Akbilisim (“Licensor,” “we,” “us,” or “our”) and the purchaser or subscriber (“Licensee,” “you,” or “your”) governing your use of Buzzy, its official companion plugins, themes, templates, and related digital materials and services (collectively, the “Licensed Materials”).

Buzzy subscriptions are sold and processed directly through Paddle, our Merchant of Record. Paddle handles payment processing, recurring billing, invoicing, applicable transaction taxes, and related payment matters under its applicable Buyer Terms and policies. This Agreement governs your rights to install, activate, access, and use Buzzy and the Licensed Materials provided by Akbilisim.

By purchasing or subscribing to Buzzy, downloading or installing the Licensed Materials, activating a license key, or otherwise using Buzzy, you agree to be bound by this Agreement.

1. Overview and Definitions

  1. Buzzy Platform: Buzzy is a self-hosted publishing, viral media, and community software platform developed and distributed by Akbilisim. Depending on your subscription plan, Buzzy may include the core application, official themes, companion plugins, premium plugins, updates, documentation, and support services.
  2. Licensed Materials: The complete software distribution provided by Akbilisim, including PHP source files, Blade templates, JavaScript, CSS stylesheets, graphics, migrations, documentation, official themes, and official companion plugins.
  3. Licensee: The individual or legal entity that has purchased a valid subscription for Buzzy and to whom this Agreement applies.
  4. Ownership: The Licensed Materials are licensed to you, not sold. Except for rights expressly granted under this Agreement or applicable third-party open-source licenses, Akbilisim retains all rights, title, and interest in and to the Licensed Materials.

2. Grant of License

Subject to your continuous compliance with this Agreement and the terms of your selected subscription plan, Akbilisim grants you a limited, non-exclusive, non-transferable license to install, customize, and operate the Licensed Materials on the number of production websites permitted by your plan.

Your subscription does not transfer ownership of Buzzy or any Licensed Materials to you. The license rights granted under this Agreement apply only to the specific websites and installations permitted by your active subscription and license activation allowance.

3. Subscription License Tiers

Current pricing and feature allowances for each plan are displayed on our official Pricing Page and may be updated from time to time. Your plan determines the number of permitted production websites and which Buzzy components and services are included.

3.1 Buzzy Standard

The Buzzy Standard plan includes:

  • License to install and operate Buzzy Core on one (1) production website (single domain or subdomain).
  • Access to the Buzzy core platform, themes, and built-in post formats and features included with the Standard plan.
  • Access to eligible software downloads, maintenance releases, and security updates while the subscription remains active.
  • Standard technical support while the subscription remains active.
  • Unlimited local development and private staging installations associated with the single licensed production website.

Note: Premium companion plugins are not included with the Standard plan and require a separate eligible subscription, add-on, or upgraded plan.

3.2 Buzzy Pro

The Buzzy Pro plan includes:

  • License to install and operate Buzzy and all official premium plugins on one (1) production website (single domain or subdomain).
  • Access to the complete Buzzy core platform.
  • Full access to official premium companion plugins designated for the Pro plan, including:
    • Buzzy Content Agent
    • Buzzy Subscriptions
    • Buzzy Quizzes
    • Buzzy SEO Pro
    • Buzzy Forum
    • Buzzy Contact
  • Eligible software downloads and automatic updates while the subscription remains active.
  • Priority Technical Support while the subscription remains active.
  • Unlimited local development and private staging installations associated with the licensed production website.

3.3 Buzzy Agency

The Buzzy Agency plan includes:

  • License to install and operate Buzzy Core and all official premium plugins across up to ten (10) production websites (client sites or network domains).
  • Access to the complete Buzzy core platform.
  • Access to official premium companion plugins designated for the Agency plan (including Buzzy Content Agent, Buzzy Subscriptions, Buzzy Quizzes, Buzzy SEO Pro, Buzzy Forum, Buzzy Contact, and future official plugins).
  • Eligible software downloads and automatic updates for all active installations while the subscription remains active.
  • VIP Developer Support and high-priority technical assistance.
  • May include early access to selected beta releases, new integrations, and preview features where offered.
  • Local development and staging installations associated with each licensed production website.

The Agency plan is designed for digital agencies, web developers, media networks, and enterprises operating multiple client properties.

4. Website and Activation Limits

  1. A production website means a publicly accessible live website or domain on which Buzzy is installed, operated, or accessed by end users.
  2. Each Standard or Pro subscription provides one (1) production website activation. Agency subscriptions provide up to ten (10) production website activations.
  3. Domain Reassignment: A license activation may be transferred from one domain to another by deactivating the previous installation and activating the replacement domain through your Akbilisim customer portal or admin dashboard.
  4. Anti-Abuse Restrictions: You may not use automated domain rotation, rapid activation resets, or similar techniques to circumvent the production website limit of your plan.

5. Development, Staging, and Testing Environments

Development, staging, testing, and local environments used solely in connection with preparing, testing, or maintaining an already licensed production website do not count as additional production website activations.

Permitted non-production environments include:

  • "localhost" and local IP addresses
  • Local development domains such as ".test", ".local", ".example", or ".dev"
  • Private, password-protected staging or testing subdomains (e.g., "staging.yourdomain.com")
  • Temporary migration or sandbox environments

These environments must be non-public and must not be used to host live content, serve public traffic, or operate independent commercial websites.

6. Premium Plugins and Companion Extensions

  1. Premium Buzzy plugins are modular extensions that enhance the core platform.
  2. Where a premium plugin is included as part of an active Buzzy Pro or Agency subscription, your right to receive new versions, software updates, security patches, and support for that plugin continues while your subscription remains active.
  3. Premium plugins require a compatible version of the Buzzy core platform to function properly.
  4. Standalone plugin purchases or add-ons (where offered) are governed by the specific entitlement terms disclosed at the time of checkout.

7. Permitted Uses and Source Customization

Subject to the terms and limitations of your plan, you are permitted to:

  • Install, deploy, and operate Buzzy on your permitted production websites.
  • Modify, customize, and adapt the editable source code (PHP, JavaScript, CSS, HTML, Blade views, and configuration files) to fit the specific needs of your licensed websites.
  • Integrate Buzzy with third-party APIs, authentication providers, payment gateways, advertising networks, analytics platforms, and content delivery networks.
  • Monetize your licensed websites through display advertising, sponsored content, paid user subscriptions, affiliate marketing, digital goods, or other lawful business models.
  • Build, design, and deliver client websites within the website activation allowance of your subscription tier.
  • Create secure, private backups reasonably necessary to operate, maintain, and restore your licensed websites.

8. Restrictions and Prohibited Uses

You expressly agree that you shall NOT:

  • No Standalone Redistribution: Resell, redistribute, sublicense, lease, rent, donate, broadcast, or share Buzzy, its companion plugins, themes, or any part of the source code as a standalone software package, script archive, or digital asset.
  • No Public Hosting: Upload, publish, or expose the source code, premium packages, license keys, or activation credentials on public repositories (such as public GitHub/GitLab repositories), file-sharing networks, torrent trackers, warez forums, or “nulled” script directories.
  • No Competing Products: Use the Licensed Materials or any substantial portion thereof to create, market, or distribute a competing general-purpose CMS, website builder platform, script marketplace product, or derivative software package.
  • No Circumvention: Bypass, alter, disable, reverse-engineer, or tamper with license verification routines, domain activation limits, subscription checks, or update authorization services.
  • No Removal of Notices: Remove, obscure, or alter any copyright notices, trademark headers, author attributions, or proprietary markings belonging to Akbilisim in the codebase.
  • No Misrepresentation: Misrepresent yourself as the original creator, author, owner, or official distributor of Buzzy or Akbilisim software.

9. Subscription Billing, Renewal, and Expiration

  1. Billing via Paddle: Buzzy subscriptions are billed through Paddle at the recurring interval (annual or otherwise) and price agreed upon during checkout.
  2. Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the scheduled renewal date.
  3. Cancellation: You may cancel your subscription at any time via your Akbilisim customer portal or through Paddle’s subscription-management tools. Cancellation prevents future renewal charges and keeps your benefits active through the end of the current, already-paid billing period.
  4. Subscription Expiration: If your subscription expires or is not renewed:
    • Previously installed and activated versions of Buzzy and companion plugins on licensed production websites will continue to operate. Existing website content is not remotely disabled.
    • Access to new software downloads and packages will cease.
    • Access to future software updates, security patches, and new feature releases will stop.
    • Automatic in-app update delivery will cease.
    • Access to technical support will stop.
    • New production website activations will be disabled.
    • Subscription-dependent cloud services or online tools may become unavailable.
  5. Renewal: Renewing an expired subscription restores access to downloads, updates, support, and activation capabilities.

10. Software Updates and Technical Support

  1. Updates: Active subscriptions provide access to official software updates, which may include security patches, bug fixes, performance optimizations, compatibility updates for new PHP/database versions, and new features.
  2. Support Levels:
    • Standard Plan: Standard technical support for installation, core configuration, and bug reporting.
    • Pro Plan: Priority Technical Support with expedited response times for core platform and premium plugins.
    • Agency Plan: VIP Developer Support with highest-priority ticket handling and advanced troubleshooting assistance.
  3. Support Scope: Support covers assistance with official Buzzy software, standard installation, built-in features, and confirmed reproducible bugs. Support does not cover custom feature development, bespoke programming, third-party server/hosting administration, or troubleshooting third-party modifications and unapproved plugins.

11. Third-Party Services, AI Providers, and Publisher Payment Gateways

Buzzy offers optional integrations with external platforms, APIs, and services:

AI Integrations (Buzzy Content Agent)

  • Buzzy Content Agent enables you to connect third-party artificial intelligence providers (such as OpenAI, Anthropic, Google Gemini, and others) for automated content generation, rewriting, and workflows.
  • Akbilisim does not provide bundled AI credits, API tokens, or free third-party AI usage unless expressly stated.
  • You are responsible for obtaining and maintaining your own API keys with your chosen AI providers and paying any fees charged by those providers.
  • You are responsible for ensuring that AI-generated content published on your website complies with applicable laws, third-party terms, and copyright standards.

Publisher Payment Integrations (Buzzy Subscriptions)

  • Buzzy Subscriptions enables you to create memberships, paid paywalls, and subscriber tiers for users of your own website.
  • Transactions between you and your end users are processed through the payment gateway accounts (e.g., Stripe, PayPal, Razorpay) that you configure.
  • Akbilisim is not the Merchant of Record for payments made by your website’s visitors or members and does not collect or process those payments.
  • You are solely responsible for compliance with payment processor terms, tax collection, invoicing, refunds, chargebacks, and legal disclosures for your website users.

12. License Verification and Telemetry

  1. Buzzy periodically communicates securely with Akbilisim licensing servers to verify subscription validity, authorize automatic updates, validate new plugin activations, and prevent fraudulent distribution.
  2. Transmitted data is strictly limited to technical metadata, including license keys, domain name/URL, server IP address, Buzzy version, PHP version, and request timestamps.
  3. Privacy Guarantee: Our licensing system does not inspect, read, collect, or store the private editorial content, articles, user comments, or member data from your self-hosted website.

13. Intellectual Property and Ownership

All intellectual property rights, trademarks, copyrights, trade secrets, architecture, database schemas, and proprietary code in Buzzy and the Licensed Materials remain the exclusive property of Akbilisim or its licensors. This Agreement grants you limited usage rights and does not sell or assign any intellectual property ownership to you.

Third-party and open-source components bundled with Buzzy remain subject to their respective open-source licenses (such as the MIT License for Laravel framework components).

14. Suspension and Termination for Breach

  1. We may temporarily suspend access to licenses, downloads, updates, services, or accounts where reasonably necessary to investigate suspected fraud, unauthorized redistribution, license abuse, security threats, payment disputes, or material violations of this Agreement.
  2. If you materially breach this Agreement and fail to remedy the breach where remediation is reasonably possible, we may terminate the affected license or account.
  3. For serious violations involving piracy, intentional fraud, malicious attacks, unauthorized redistribution, or deliberate circumvention of license protections, immediate suspension or termination may be appropriate.
  4. Termination for breach does not create an additional right to a refund except where a refund or other remedy is required under applicable law or Paddle’s applicable policies.

15. Refunds and Payment Disputes

  1. Subscriptions and purchases are processed by Paddle under Paddle’s Buyer Terms and Refund Policy.
  2. Refund inquiries may be submitted through Paddle buyer support or by contacting Akbilisim at [email protected].
  3. If a chargeback, payment reversal, or payment dispute is initiated, access to the affected license or subscription services may be temporarily suspended while the transaction is reviewed.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUZZY AND THE LICENSED MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

AKBILISIM EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT BUZZY WILL MEET YOUR SPECIFIC REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, BE COMPLETELY ERROR-FREE, OR GENERATE ANY SPECIFIC LEVEL OF TRAFFIC, AUDIENCE ENGAGEMENT, OR REVENUE.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AKBILISIM, ITS FOUNDERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, BUSINESS INTERRUPTION, OR PROCUREMENT OF SUBSTITUTE SERVICES) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE USE OF BUZZY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR USE OF BUZZY SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU FOR THE APPLICABLE SUBSCRIPTION OR LICENSE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

18. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the Republic of Turkey, without giving effect to conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to this Agreement shall be submitted to the exclusive jurisdiction of the competent courts and enforcement offices of Istanbul, Turkey, subject to any mandatory consumer-protection laws that apply in your jurisdiction.

19. Relationship to Other Terms

This Agreement governs your license to install, customize, and operate Buzzy. Your access to our websites, customer accounts, billing systems, and support services is also governed by our:

Payments and subscriptions handled by Paddle are additionally subject to Paddle’s applicable Buyer Terms and policies.

20. Changes to This Agreement

We may update this Agreement from time to time to reflect changes to Buzzy, subscription plans, licensing systems, legal requirements, or business operations.

The current version will be published on our website together with its “Last Updated” date.

Material changes will apply in accordance with applicable law and will not retroactively remove rights that cannot lawfully be modified.
